1. Agreement to Terms

By accessing and using the Pawmorial website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. Use of Service

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the service in any way that violates any applicable law or regulation
• Upload or share content that is offensive, harmful, or infringes on others' rights
• Attempt to gain unauthorised access to any part of the service
• Use the service to transmit spam or unsolicited communications
• Impersonate another person or entity
• Interfere with or disrupt the service or its servers

3. Account Registration

To create a memorial or access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep it updated.

4. Memorial Content

When you create a memorial, you retain ownership of the content you upload. By uploading content, you grant us a non-exclusive, worldwide licence to:

• Display your content on memorial pages
• Store and backup your content
• Process and optimise your content for display on various devices
• Share public memorial content and tribute videos on our official social media channels (see section 5)

You are solely responsible for the content you upload and must ensure you have the right to share it. We reserve the right to remove content that violates these terms or is reported as inappropriate.

5. Social Media Sharing

By setting your memorial or tribute video to public, you acknowledge and agree that we may share this content on our official social media channels to honour and celebrate the lives of beloved pets. Our social media channels include:

• Instagram: https://instagram.com/pawmorials

You may withdraw your consent for social media sharing at any time by changing your memorial's privacy settings to private or disabling sharing on your tribute video from your dashboard. Upon receiving your request, we will remove the content from our social media channels within 48 hours and send you a confirmation email once the removal is complete.

Private memorials and tribute videos with sharing disabled will never be shared on social media. You may also contact us at privacy@pawmorial.co.uk to request removal at any time.

6. Products and Orders

All products are subject to availability. We reserve the right to discontinue any product at any time. Prices are subject to change without notice. We take care to accurately describe our products, but we do not warrant that product descriptions or other content on the site are accurate, complete, or error-free.

7. Payment

Payment for products and subscriptions is processed securely through Stripe. You agree to provide current, complete, and accurate purchase and account information. All payments are in British Pounds (£) unless otherwise stated.

8. Premium Subscriptions

Premium subscriptions are billed on a recurring basis. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. We do not offer refunds for partial months.

9. Intellectual Property

The Pawmorial name, logo, website design, and all original content created by us are our intellectual property and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Limitation of Liability

To the fullest extent permitted by law, Pawmorial shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Pawmorial and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

12. Memorial Preservation

We are committed to preserving memorials for the long term. However, we cannot guarantee perpetual availability. We will make reasonable efforts to notify you if we ever need to discontinue the service.

13. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the service will cease immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new terms on this page. Your continued use of the service after changes constitute acceptance of the new terms.
